1. Acceptance of Terms

By accessing, browsing, or using the Funding Radar website, application, or any associated services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include that organization. If you do not agree to all of these Terms, you must immediately discontinue use of the Service. Your continued access to or use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

Funding Radar is a privately operated information platform that aggregates publicly available federal funding opportunity data and presents it in a user-friendly format to assist rural health organizations and other interested parties in discovering grant opportunities. The Service includes grant listings, editorial summaries, topic categorizations, fit assessments, deadline tracking, and related tools.

Funding Radar is NOT a government website, government service, or government agency. Funding Radar does NOT issue, award, distribute, or administer grants or any form of government funding. Funding Radar does NOT submit grant applications on your behalf. Funding Radar does NOT guarantee the accuracy, completeness, or currency of any information displayed on the platform.

The Service is provided solely for informational and educational purposes. It is designed to help users become aware of publicly available funding opportunities and should be used as a starting point for further research, not as a sole or definitive source of grant information.

3. No Government Affiliation

Funding Radar is an independent, privately owned and operated service. We are NOT affiliated with, endorsed by, sponsored by, authorized by, or in any way officially connected to the United States government or any of its departments, agencies, or instrumentalities, including but not limited to: the U.S. Department of Health and Human Services (HHS), the Health Resources and Services Administration (HRSA), the Substance Abuse and Mental Health Services Administration (SAMHSA), the Centers for Disease Control and Prevention (CDC), the U.S. Department of Agriculture (USDA), the National Institutes of Health (NIH), the Centers for Medicare & Medicaid Services (CMS), the Federal Emergency Management Agency (FEMA), Grants.gov, or any state, county, tribal, or local government entity.

Any references to government agencies, programs, or funding opportunities on this platform are made solely for informational purposes and do not imply any affiliation, endorsement, or official relationship. The names and logos of government agencies are trademarks or service marks of their respective owners and are used here only for identification purposes.

4. No Professional Advice

Nothing on the Funding Radar platform, including but not limited to grant summaries, fit assessments, topic tags, eligibility indicators, editorial content, blog posts, or any other materials, constitutes or should be construed as legal advice, financial advice, tax advice, medical advice, professional grant-writing advice, consulting services, or any other form of professional guidance.

Funding Radar is an information aggregator only. The information provided through the Service is general in nature and is not tailored to any specific organization's circumstances, needs, or eligibility status.

You should consult with qualified professionals, including grant writers, attorneys, accountants, and compliance specialists, before making any decisions based on information found on this platform. You should not rely on the Service as a substitute for professional judgment or official guidance from the issuing agency.

5. Accuracy of Information

While Funding Radar endeavors to provide accurate and up-to-date information, we make NO representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, timeliness, or availability of any information displayed on the platform.

Information on the Service is sourced from publicly available federal APIs and government websites, including Grants.gov and Simpler.Grants.gov. However, the data displayed on our platform may be incomplete, outdated, contain errors, or differ from the current official data maintained by the issuing agency. Grant deadlines, award amounts, eligibility criteria, application requirements, and other details may change at any time without notice to us or to you. Data synchronization delays may result in information on our platform not reflecting the most current official data.

YOU MUST ALWAYS VERIFY ALL GRANT INFORMATION, INCLUDING BUT NOT LIMITED TO DEADLINES, ELIGIBILITY REQUIREMENTS, AWARD AMOUNTS, AND APPLICATION PROCEDURES, DIRECTLY WITH THE OFFICIAL SOURCE, INCLUDING GRANTS.GOV AND THE ISSUING AGENCY, BEFORE TAKING ANY ACTION OR MAKING ANY DECISION BASED ON INFORMATION FOUND ON THIS PLATFORM.

6. No Guarantee of Eligibility

Any "fit scores," "match percentages," topic tags, eligibility indicators, eligibility summaries, or similar features provided through the Service are our editorial and algorithmic interpretations of publicly available grant criteria. These assessments are NOT official eligibility determinations and should NOT be relied upon as such.

Only the issuing federal agency has the authority to determine whether an applicant is eligible for a specific funding opportunity. A high fit score or favorable eligibility indicator on our platform does not mean you are eligible for a grant. Conversely, a low score or unfavorable indicator does not mean you are ineligible. These features are provided solely as a convenience to help users prioritize which opportunities to investigate further.

Funding Radar expressly disclaims any responsibility for eligibility determinations or for any decisions you make based on our fit assessments, topic tags, or other editorial features.

7. No Guarantee of Funding

Use of the Funding Radar platform, whether free or paid, does NOT guarantee that you will receive any grant, funding, award, or any other financial benefit. Grant awards are determined solely by the issuing agency based on their review criteria and processes, over which Funding Radar has no control or influence whatsoever. Funding Radar does not participate in, influence, or have any role in the grant review, selection, or award process of any federal, state, or local agency.

8. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUNDING RADAR, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE "FUNDING RADAR PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

  • Damages arising from your use of or inability to use the Service;
  • Damages arising from any reliance on information provided through the Service;
  • Damages arising from missed grant deadlines or application windows;
  • Damages arising from incorrect, incomplete, or outdated data displayed on the platform;
  • Damages arising from failed, rejected, or unsuccessful grant applications;
  • Damages arising from loss of funding, revenue, business opportunities, or anticipated savings;
  • Damages arising from unauthorized access to or alteration of your data or transmissions;
  • Damages arising from service interruptions, errors, bugs, viruses, or other technical issues;
  • Damages arising from the conduct or content of any third party on or related to the Service;
  • Any other damages arising out of or in connection with these Terms or the Service;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE FUNDING RADAR PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE FUNDING RADAR PARTIES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO FUNDING RADAR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Funding Radar Parties from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, rule, or regulation; (d) any content or information you submit, post, or transmit through the Service; (e) your reliance on any information provided through the Service; (f) any grant applications you submit based in whole or in part on information obtained through the Service; or (g) your infringement or misappropriation of any third party's intellectual property or other rights. This indemnification obligation shall survive the termination of these Terms and your use of the Service.

10. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You may not share your account credentials with any other person or entity, and you may not allow others to access the Service using your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Funding Radar shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Funding Radar reserves the right to suspend, disable, or terminate your account at any time, for any reason or no reason, with or without notice, including but not limited to if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behavior, or if your account poses a security risk.

11. Subscriptions and Billing

Funding Radar offers both free and paid subscription tiers. Paid subscriptions ("Pro" plans) are billed on a recurring monthly basis at the rate displayed at the time of purchase, unless otherwise stated. All fees are quoted in U.S. dollars and are exclusive of any applicable taxes, which you are responsible for paying.

You may cancel your paid subscription at any time through your account settings. Upon cancellation, your access to paid features will continue through the end of your current billing period, after which your account will revert to the free tier. No refunds or credits will be issued for partial billing periods, unused features, or any other reason, except as required by applicable law.

Funding Radar reserves the right to change subscription pricing at any time. If pricing changes affect your current subscription, we will provide reasonable notice before the new pricing takes effect. Your continued use of the paid Service after the effective date of a price change constitutes your acceptance of the new pricing.

Funding Radar reserves the right to modify, suspend, or discontinue any features, tiers, or aspects of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service or any part thereof.

12. Intellectual Property

The Funding Radar platform, including but not limited to its design, layout, user interface, graphics, logos, icons, software, code, algorithms, editorial content, summaries, fit score methodologies, topic taxonomies, analyses, and all other proprietary materials, is owned by Funding Radar or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. All rights not expressly granted herein are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal, non-commercial purposes (or for the internal purposes of the organization on whose behalf you are using the Service) in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from the Service, except as incidentally necessary for ordinary use of the Service.

Federal grant data sourced from government websites and APIs (e.g., Grants.gov) is in the public domain and is not subject to our copyright claims. However, our editorial enhancements, summaries, analyses, categorizations, and presentation of such data are proprietary and protected by applicable intellectual property laws.

13. Third-Party Links and Content

The Service may contain links to third-party websites, applications, or resources, including but not limited to Grants.gov, Simpler.Grants.gov, and other government agency websites. These links are provided solely for your convenience and informational purposes. Funding Radar does not control, endorse, sponsor, or assume any responsibility for the content, accuracy, privacy policies, practices, or availability of any third-party websites or resources. Your interactions with any third-party website or resource are solely between you and that third party, and you access such websites and resources at your own risk. Funding Radar shall not be liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available on or through any third-party website or resource.

14. Data Privacy

Funding Radar collects and processes minimal personal data necessary to provide the Service. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your information as described in our Privacy Policy.

We do not sell, rent, or trade your personal information to third parties. We may use third-party service providers to assist in operating the Service, and such providers are bound by contractual obligations to protect your data. You acknowledge that no method of electronic transmission or storage is completely secure, and Funding Radar cannot guarantee the absolute security of your data.

15. Modifications to Terms

Funding Radar reserves the right to modify, amend, or update these Terms at any time and at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page. We may, but are not obligated to, provide additional notice of material changes (such as via email or a prominent notice on the Service). Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service immediately.

16. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles. You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in West Virginia for the resolution of any disputes arising out of or relating to these Terms or the Service.

Any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

18. Severability

The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and Funding Radar regarding your use of the Service. These Terms supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, with respect to the subject matter hereof.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and Funding Radar's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
